$1 Million Medical Malpractice Case Against Downstate Hospital

Matthew Dudley and Daniel Smart settled a medical malpractice case against a downstate hospital for $1 million on behalf of a 60-year-old man who died from a heart attack. The decedent’s physician failed to recognize and manage his risk for coronary artery disease. At multiple visits, the decedent presented with signs and symptoms consistent with an acute coronary syndrome. His physician failed to perform an EKG, refer him to a cardiologist and send him to the emergency room in a timely manner. As a result, the decedent’s cardiac condition went undiagnosed and untreated, and he died from a heart attack. The decedent was survived by his wife and two adult sons.
