The wound did not heal until she was transferred to a specialty care hospital where she underwent four surgeries including the removal of her tailbone. Before the ankle fracture she had been living independently in her own home.

$750,000 – Assault And Neglect

David Pribyl and Alex Campos represented a 32 year old female who was a resident of a nursing home specializing in mental illness treatment. As a result of abuse and neglect by the staff, the female was allowed to be raped, became pregnant, and gave birth to a baby boy. Settlement was made with the nursing home.

$450,000 – Neglect

Daniel Smart settled a nursing home abuse and neglect case for $450,000. Upon admission to the defendant’s facility, the staff failed to properly assess and manage the plaintiff’s fall risk and put in place the appropriate interventions. As a result, the 84-year-old female plaintiff fell twice. The second fall resulting in a hip fracture that required surgical repair.
