$1.9 Million Dollar Settlement In Dental Malpractice Case

Matthew Dudley and Marisa Schostok represented the widow of a 55-year-old man who died during a dental filling procedure. In October 2016, the decedent was receiving a filling by a dentist who administered sedative anesthetics for the procedure. The sedating dentist improperly administered sedatives to the decedent and did so without a doctor trained in advanced life support present. During the procedure, the decedent, who had obstructive sleep apnea, began to exhibit alarmingly low blood oxygen levels and a low heart rate, indicating a blocked airway and respiratory distress. The dentist failed to recognize that the patient was unable to breathe. As a result of the dentist’s negligence, the decedent suffered respiratory depression, which led to cardiac arrest and a permanent brain injury. He died seven days later after being taken off life support. Mr. Dudley and Ms. Schostok were able to obtain a wrongful death settlement against the north suburban dentist for $1.9 million.
