Kevin Golden settled the case in which a 53-year-old plaintiff was attempting to turn off the refrigerator unit for the container. The plaintiff was told that if he did not turn off his refrigerator unit, the container would not be unloaded. The plaintiff was trained to turn off the toggle switch on the refrigerator unit with a long pole or stick. On the day of the accident, the plaintiff did not have a pole or a stick, and he attempted to climb to the top of the container. The plaintiff fell to the ground and suffered a left distal tibia and fibula open fracture.
