A fuel truck driver who had climbed to the top of his City of Chicago fuel truck and fallen off the top has settled his lawsuit for 1.4 million dollars. The plaintiff had climbed to the top of the tanker truck and opened the hatch to the tank to check the fuel level. The air pressure from opening the hatch caused the plaintiff to lose his footing, and he fell off the truck and landed on the cement floor. The plaintiff suffered an acetabular fracture that required surgery. The lawsuit was filed against two City of Chicago contractors who were required to maintain, repair and upkeep the fuel trucks. The contract required the fuel trucks to be in compliance with OSHA, and the plaintiff alleged the contractors failed to instruct the City of Chicago to implement fall protection. The plaintiff was represented by Kevin Golden and Alex Campos.
